There is no specific waste management legislation in place for Niue, but there are a combination of laws and waste management protocols. The Environment Act 2015 sets out several waste-related activities that require development consent including landfills, recycling or collection stations, drainage or disposal systems, wastewater and sanitation schemes, and human waste disposal systems.

The proposed Niue Waste management bill is a legislative instrument designed to provide for a coordinated management of solid waste in Niue. The Bill seeks to provide a safe and effective management of all waste produce in Niue to decrease impacts to the environment and community health.

Items are imported into Niue in growing numbers, but there are currently limited viable options for their end-of-life management and/or export. As such most items imported are disposed of at the dumpsites or stockpiled on vacant land. Electronic waste stockpiles, in particular are increasing resulting in increased pollution and health risks to Niue people. The priority for Niue is to introduce a financially sustainable system to enable the long term collection, management and export of recyclable and end of life electronic items, utilising the new Recycle facility (funded by the Government of Australia)

The country does however face significant challenges in achieving sustained socioeconomic development. In proportionate terms, Niue has experienced the largest population decline of any country in recent history
